Annual Board Meeting

Chad Carrick called the meeting to order at 7pm with introduction of board and HOA attorney, Josh Lorenz.

 

Quorum was met.

 

Rhonda Yankauskas discussed the neighborhood block party and other social activities that were held during the year as well as possible future activities.

 

David Chandler gave the Treasurer’s Report.  The Sahene’s requested balances of the checking and savings accounts.  David will get the exact figures to the Sahene’s.

 

Chad began a discussion on the reasons were are trying to incorporate the neighborhood.  Bob Massaro questioned if the insurance would increase once incorporated.  Josh Lorenz answered that he does not believe there would be any significant increase due to incorporating.  A question was asked if we file taxes currently.  We do not now file taxes but we would once incorporated.

 

Josh explained that Heritage Estates was set up that there could be three separate homeowner associations.  Phase I and II have operated as one but haven’t officially been one.  Phase III declarations state that there has to be a homeowners association but it does not have to join Phase I and Phase II.  We have approached Maronda about joining our HOA but the do not want to join.  They will form one on their own.  Any lots left in Phase II (Barberry and Harvest) would have to be part of the Phase II association.

 

An unincorporated association, which we are currently, leaves all homeowners responsible and could be sued as part of a lawsuit. 

 

Dino DePaulo suggested the three empty lots in Phase II should be billed the yearly due assessment.  There is however some question as to who owns the three lots.

 

Josh was asked to give his opinion as to a property management co. vs. neighbors running the management of the HOA.  It was discussed that the fees charged are based on the amount of violations, letter they need to prepare and mail, etc.  A management company makes their money by “finding” violations.  The current board feels that continuing with the neighbor run HOA is best.

 

To incorporate the HOA and join Phase I and Phase II together we need to have 50% of neighbors in both phases agree.  Josh is preparing proxies for neighbors to sign and a vote will be taken 

 

The Leavy’s asked how to find out who owns the property next to the park that is swamp like.   They were advised to contact the municipality.

 

The issue of people speeding on Harvest was brought up.  Chad suggested an island be put in the middle of the road.   Josh reminded that an island could create a problem for snow crew.  Heritage would have to pay and need to get approval from the municipality.

Council meetings are the 1st and 3rd Wednesdays of each month at 7pm.  Josh suggested Vascar lines may be helpful.
